Terms and Conditions of Sale and Use – France Pavé

Article 1: Purpose
These general terms and conditions of sale and use (hereinafter the “GTC/GTCU”) govern the contractual relationship between France Pavé, whose registered office is located at 24 rue de Clichy, 75009, Paris, registered with the Paris Trade and Companies Register under number 98434693200010, (hereinafter “France Pavé” or “the Seller”) and any natural or legal person (hereinafter “the Customer” or “the User”) wishing to consult the France Pavé website (hereinafter “the Site”) and/or purchase products (hereinafter the “Products”) offered by France Pavé.
Article 2: Acceptance of the Terms and Conditions
Any consultation of the Website and any order for Products implies full and unreserved acceptance of these GTC/GTCU by the Customer/User. The Customer/User acknowledges having read the GTC/GTCU prior to placing any order. France Pavé reserves the right to modify these GTC/GTCU at any time. The applicable GTC/GTCU are those in force on the date of consultation of the Website or placement of the order.
Article 3: Products
The Products offered for sale by France Pavé are paving stones of various types (concrete, natural stone, etc.) and may include complementary products (curbs, etc.). The essential characteristics of the Products (dimensions, materials, colors, etc.) are presented on the Website in the product descriptions. The photographs and descriptions of the Products are not contractual and are provided for information purposes only. France Pavé reserves the right to modify its Product range at any time.
The Products may be handmade. Therefore, France Pavé does not guarantee the color of the Products.
Article 4: Price
Product prices are indicated in euros (€) and include all taxes (VAT included), excluding delivery costs. Delivery costs are indicated separately before the Customer confirms the order. France Pavé reserves the right to modify its prices at any time without notice. Products will be invoiced based on the prices in effect at the time the order is placed.
Article 5: Ordering
5.1. Ordering process:
The Customer may place an order on the Website.
5.2. Order confirmation:
The order is considered firm and final after confirmation of payment by the bank and sending of the order confirmation email by France Pavé. France Pavé reserves the right to refuse or cancel any order in the event of a dispute relating to the payment of a previous order, incorrect delivery information, or for any other legitimate reason.
Article 6: Payment
Payment for Products is made online using the payment methods offered on the Website (credit card, bank transfer, etc.). Transaction security is ensured by secure payment systems. The Customer guarantees France Pavé that they have the necessary authorizations to use the chosen payment method. The order amount is debited at the time of order confirmation.
Article 7: Delivery
7.1. Delivery terms:
The delivery terms and costs are specified on the Website and depend in particular on the type of Products, the quantity ordered, and the delivery location. Delivery is made to the address indicated by the Customer when placing the order. The Customer undertakes to provide accurate and complete delivery information.
7.2. Delivery times:
Delivery times are indicated on the Website for information purposes only and run from the date of order confirmation. France Pavé endeavors to meet these deadlines, but cannot be held responsible for delivery delays attributable to the carrier or to events beyond its control (bad weather, strikes, etc.).
7.3. Receipt of Products:
Upon receipt of the Products, it is the Customer's responsibility to check the condition of the packaging and that the Products delivered comply with their order. In the event of any anomaly (damaged packaging, missing or non-compliant Products), the Customer must make specific and reasoned reservations on the delivery note and inform France Pavé in writing (by email or registered letter with acknowledgment of receipt) within 3 days of receipt. If no reservations are made within the specified period, the Products will be deemed to have been accepted as compliant.
Article 8: Right of withdrawal

To exercise their right of withdrawal, Customers must notify France Pavé of their decision to withdraw by means of an unambiguous statement (e.g., letter sent by post or email). Please send an email to hello@francepave.com with your order number, explicitly stating that you wish to exercise your right of withdrawal.
The Products must be returned to France Pavé in their original condition and complete (packaging, accessories, instructions, etc.), accompanied by the purchase invoice, no later than fourteen (14) days after notification of the decision to withdraw, to the postal address provided by FRANCE PAVÉ in response to the Customer's notification of withdrawal.
Under no circumstances should a product be returned to the head office or administrative offices of FRANCE PAVÉ.
Products must be returned on their original pallet or on new pallets if they were shipped to you on a pallet.
France Pavé will refund the Customer for all sums paid, including standard delivery costs, within fourteen (14) days of receiving the returned Products or proof of their shipment. The refund will be made using the same payment method used by the Customer when placing the order, unless the Customer expressly agrees otherwise.
8.1. Exceptions:
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised, in particular, for:
- goods manufactured according to the Customer's specifications or clearly personalized (examples: cutting (chain, rope, garden hose, electrical cable, chimney pipe, wood, glass, worktop, etc.), paint tinted at the Customer's request and, in general, any item made to measure, i.e., resized and/or customized for the Customer (joinery, window, cupboard door, etc.);
- goods that are likely to deteriorate or expire rapidly;
- Goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection (in particular PPE (gloves, respiratory protection, goggles) as they may have come into contact with hazardous substances; Gas pipes as they may have been replaced or damaged; Locks and cylinders, as the keys may have been copied; Paste/powder/liquid/gas products, as they may have been altered or substituted; Batteries, due to the risk of deterioration, substitution, or alteration of the product);
- the supply of goods or services whose price depends on fluctuations in the financial market beyond the control of FRANCE PAVÉ and which may occur during the withdrawal period;
- goods which, after delivery and due to their nature, are inseparably mixed with other items.
Article 9: Warranties
These provisions do not apply to professionals within the meaning of the Consumer Code. However, professionals may still benefit from the warranty against hidden defects.
The seller is liable for any lack of conformity of the goods ordered under the conditions set out in Articles L217-3 to L217-20 of the Consumer Code and for any hidden defects in the goods sold under the conditions set out in Articles 1641 et seq. of the Civil Code. The Seller cannot anticipate any specific needs of the Customer, who must therefore inform the Seller in order to receive appropriate advice on the choice of product and must specify this need in the order.
The legal guarantee of conformity applies regardless of any commercial warranty that may be granted.
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it occurred.
Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee shall apply to that digital content or digital service throughout the period of supply provided for. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it occurred.
The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to them.
If the item is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
For any warranty claim, the Customer must contact France Pavé in writing, specifying the defect found and attaching the purchase invoice.
Article 10: Liability
France Pavé cannot be held liable in the event of non-compliance with these GTC/GTCU by the Customer, in the event of force majeure, or due to the unforeseeable and insurmountable actions of a third party.
The Website may contain hypertext links to other websites. France Pavé is not responsible for the content of these third-party websites.
Article 11: Intellectual Property
All elements of the Website (text, images, logos, trademarks, etc.) are and remain the exclusive intellectual property of France Pavé. Any reproduction, representation, distribution, use, or modification, in whole or in part, of the Website or any of its elements is strictly prohibited without the prior written consent of France Pavé.
Article 12: Personal Data
France Pavé collects and processes the Customer's/User's personal data under the same conditions as Odoo.
Article 13: Applicable Law and Dispute Resolution
These Terms and Conditions are governed by French law. In the event of a dispute relating to the interpretation, performance, or validity of these Terms and Conditions, and in the absence of an amicable settlement, the competent courts shall be those of [City of the competent court].
